Unlike many other insolvency practitioners who outsource employee claims or assign them to general case administrators, we have a specialist employment team that exclusively handles this process. This focused approach ensures that employees and directors alike receive clear, informed, and timely assistance throughout the insolvency process.
We also assist directors in making claims in their capacity as employees. While this presents additional challenges, we work diligently to overcome obstacles wherever possible.
The employee claims process
When a company enters administration or liquidation, our employment team follows a bespoke structured approach to ensure employees are fully informed and supported:
- Initial contact & information gathering: A member of our employment team is introduced to the company director to provide a point of contact. We request essential employee and payroll information to calculate claims for wages, holiday pay, notice, and redundancy.
- Dismissal & redundancy support: If dismissals are necessary, we prepare the required dismissal letters. We can attend the business site to assist directors in making employees redundant either pre or post insolvency, and explain their rights.
- Post-insolvency assistance: We guide employees through the claim submission process to the Redundancy Payments Service (RPS) and provide ongoing support for employees with questions regarding their payments and any additional claims.

Addressing employment challenges in insolvency

Company directors are provided with employment advice, including templates for redundancy letters. Employees receive direct communication detailing their claims and expected payment dates. If they have any concerns, they are given a designated point of contact within our employment team for assistance.
Helping employees understand their rights
When employees are made redundant, they receive a dismissal letter outlining their entitlements and how to make a claim. This includes a summary of what they can claim from the RPS and contact details for their assigned employment team member.
Once the company is in formal insolvency, employees receive further communication, including:
- The Redundancy Payments Services (“RPS”) case reference for claim submission.
- A factsheet summarising their claims. statutory limits and the process.
