Solvent restructuring
At McTear Williams & Wood we not only deal with insolvent businesses but also solvent businesses looking to restructure.
This is often tax driven and we work with existing advisors to ensure the most tax efficient mechanism is used to distribute funds back to the shareholders. What starts off as a solvent liquidation can become insolvent, so, perhaps surprisingly, solvent liquidations have to be carried out by a licensed Insolvency Practitioner.
We have experience of dealing with:
- Section 110 reorganisations
- Use of the Inland Revenue concessions
- Members voluntary liquidations
The main purpose of a solvent restructuring is to distribute assets back to members as quickly and efficiently as possible. We always encourage the directors to sell the assets and pay the creditors prior to putting the company into liquidation as this helps to reduce the costs of liquidation.
